The second win in court in a row for MUT: The CRPD loses the second warrant of prohibitory injunction against the MUT.

The CRPD et. lost the second case in court against the MUT. The court issued the first decree on Friday 13th June stating that it cannot accede to the CRPD et. request for a warrant of prohibitory injunction.

Upon the second request for a warrant of prohibitory injunction by CRPD et, the court heard the case earlier this week and issued the decree on Friday 4th July whereby the request by CRPD et. for a warrant of prohibitory injunction was again refused.

The CRPD et. and the Ministry of Inclusion mounted an attack on the MUT and its members to change current practices in place during examinations in middle and secondary schools. The MUT has been a pioneer in inclusion in Malta and has introduced inclusion in schools through the provision of LSEs and dedicated inclusion programmes well before the enactment of the CRPD or its Ministry. The Union and its members do not expect any appreciation from the CRPD et. or its Ministry – this was never forthcoming and is shameful. However the Union will not allow anyone, including persons close to CRPD, to blackmail it with a narrative to portray MUT and its members as insensitive towards students with disabilities.

The court decision is not just a win for the MUT – it is a loss for the CRPD et. and the Inclusion Ministry who should know better when enacting two consecutive cases in court which hold no grounds.

The MUT thanks its Officials and its Lawyers Dr Keith Borg and Dr Rebecca Mercieca.
